a) When visiting the website

When you visit our website www.colehaan.eu, information is automatically sent to our website's server by the browser used on your device. This information is temporarily stored in a log file. The following information will be recorded without your intervention and stored until it is automatically deleted:

  • Evaluating system security and stability as well as for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f) of the GDPR. Our legitimate interest follows from the purposes of the data collection listed above. Under no circumstances, do we use the collected data for the purposes of making conclusions about you.

In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations under Paragraphs 4 and 5 of this Privacy Policy.

b) When using our contact form

If you have any questions, we offer you the opportunity to contact us via a form provided on the website. For this purpose, a valid e-mail address must be provided so that we know who the request is from and in order to be able to respond to it. Further information can be provided voluntarily by you.

Data processing for the purposes of contacting us is carried out in accordance with Art. 6 para. 1 sentence 1 lit. a) of the GDPR on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after the enquiry you have made has been dealt with.

3. Disclosure of data

Your personal data will not be transmitted to Third Parties for purposes other than those listed below.

We will only share your personal information with Third Parties if: you have given your express consent in accordance with Art. 6 (1) sentence 1 (a) of the GDPR, the disclosure pursuant to Art. 6 (1) sentence 1 (f) of the GDPR is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data, in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c) of the GDPR and that this is legally permissible and necessary for the processing of the contractual relationships with you in accordance with Art. 6 (1) sentence 1 (b) of the GDPR.

4. Cookies

We use cookies on our site. These are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device and do not contain any kind of viruses, Trojans or other malware.

The cookie stores information that arises in connection with the specific end device used. However, this does not mean that we will have direct knowledge of your identity.

Firstly, the use of cookies serves to make the use of our offer more agreeable for you, for example, we use so-called session cookies to recognise that you have visited individual pages of our website. These cookies are automatically deleted after you leave our site.

5. Special uses of websites

Use of our webshop

(1) If you want to order in our webshop, it is necessary for the conclusion of the contract that you provide your personal data, which we need for the processing of your order. Mandatory information required for the execution of the contracts is marked separately, further information is voluntary. We process the data you provide to process your order. For this purpose, we may pass on your payment data to our house bank, the legal basis is Art. 6 para. 1 sentence 1 lit. b) of the GDPR. You can voluntarily create a customer account through which we can save your data for future purchases. When you create an account under "My Account", the data you provide will be revocably stored. You can always delete all other data, including your user account, in the customer area. We may process the data you provide to inform you about other interesting products from our portfolio or to send you e-mails with technical information.

(2) Due to commercial and tax regulations, we are obliged to store your address, payment and order data for a period of ten years. However, after two years, we will apply restricted processing, i.e. your data will only be used to comply with legal obligations.

To prevent unauthorised access to your personal data by Third Parties, the ordering process is encrypted using TLS technology or similar.

6. Newsletter

(1) With your consent, you can subscribe to our newsletter, which we use to inform you about our offers. The advertised goods and services are named in the declaration of consent.

(2) To register for our newsletter, we use the so-called double opt-in procedure. This means that after you have registered, we will send you an e-mail to the e-mail address that you have provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration within 12 hours, your information will be blocked and automatically deleted after one month. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of these procedures is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data.

(3) The only mandatory information for sending the newsletter is your e-mail address. The provision of further, separately marked data is voluntary and will be used to address you personally. After your confirmation, we will store your e-mail address for the purpose of sending the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. a) of the GDPR.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare your withdrawal by clicking on the link provided in each newsletter e-mail, or by e-mail to the contact details given in the form.

(5) We should like to point out that we evaluate your user behaviour when sending the newsletter. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which represent single-pixel image files that are stored on our website. For the evaluations, we link the data mentioned in (3) and the web beacons with your e-mail address and an individual ID. We use the data obtained in this way to create a user profile in order to tailor the newsletter to your individual interests. In doing so, we record when you read our newsletters, which links you click on and infer your personal interests from this. We link this data to actions you take on our website.

You can object to this tracking at any time by clicking on the separate link provided in each e-mail or by informing us via another contact channel, e.g. by e-mail. The information will be stored for as long as you have subscribed to the newsletter. After a deregistration, we store the data purely statistically and anonymously.

7. Analysis tools

a) Tracking tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 para. 1 sentence 1 lit. f) of the GDPR. With the tracking measures used, we want to ensure a needs-based design and the continuous optimisation of our website. Firstly, we use the measures to record statistically the use of our website and for the purposes of optimising our offers. These interests are justified within the meaning of Art. 6 para. 1 sentence 1 lit. f) of the GDPR. The respective data processing purposes and data categories can be found in the corresponding tracking tools.

aa) Google Analytics

For the purposes of needs-based design and the continuous optimisation of our pages, we use Google Analytics, this is a web analysis service provided by Google Inc. at (https://www.google.de/intl/de/about/) (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; hereinafter referred to as "Google"). In this context, pseudonymised user profiles are created and cookies are used. The information generated by the cookie about your use of this website, such as :

Browser type/version, Operating system used, Referrer URL (the previously visited page), The host name the accessing computer (IP address), Time of the server request,

are transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website activity and internet use for the purposes of market research and for the needs-based design of these websites. This information may also be transferred to Third Parties if this is required by law or if Third Parties process this data on behalf of other Third Parties. Under no circumstances will your IP address be merged with other data held by Google. The IP addresses are anonymised so that an assignment is not possible, (known as IP masking).

bb) Google Adwords Conversion Tracking

In order to statistically record the use of our website and evaluate it for the purposes of optimising our website for you, we also use Google Conversion Tracking. Google Adwords will place a cookie on your computer if you have reached our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, both Google and the customer can see that the user has clicked on the ad and has been redirected to this page.

Each Adwords customer receives a different cookie. Cookies can, therefore, not be tracked via the websites of Adwords customers. The information obtained with the help of the conversion cookie is used to compile conversion statistics for Adwords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to identify users personally. On the basis of Art. 6 para. 1 sentence 1 lit. f) of the GDPR, we use social plug-ins from the social networks Facebook, Twitter and Instagram on our website in order to make our company better known. The advertising purpose behind it is to be regarded as a legitimate interest within the meaning of the GDPR. Responsibility for data protection compliant operations must be guaranteed by their respective providers. The integration of these plug-ins by us is carried out by means of the so-called two-click method in order to protect visitors to our website in the best possible way.

a) Facebook

On our website, social media plug-ins from Facebook are used to make their use more personal. For this we use the "LIKE" or "SHARE" button. It is an offer from Facebook. If you call up a page of our website that contains such a plug-in, a direct connection is established between your browser and the Twitter server. Twitter thus receives the information that you have visited our site with your IP address. If you click the Twitter "tweet button" whilst logged into your Twitter account, you can link the contents of our pages to your Twitter profile. This allows Twitter to assign the visit to our pages to your user account. We should like to point out that we, as the provider of the pages, have no knowledge of the contents of the transmitted data or its use by Twitter. c) Instagram

Our website also uses so-called social plug-ins ("plug-ins") from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram").

The plug-ins are equipped with an Instagram logo, e.g. in the form of an "Instagram camera". We give you the opportunity to communicate directly with the provider of the plug-in via the button. Only if you click on the marked field and activate it, will the plug-in provider receive the information that you have accessed the corresponding website of our online offer. In addition, the data mentioned in this statement will be transmitted. In the case of Facebook and Xing, according to the respective providers in Germany, the IP address is anonymised immediately after collection. By activating the plug-in, your personal data is transmitted to the respective plug-in provider and stored there, (in the case of US providers in the USA). (3) The plug-in provider stores the data collected about you as usage profiles and uses them for the purposes of advertising and/or needs-based design of their website. Such an evaluation is carried out in particular, (also for users who are not logged in), for the purposes of displaying needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact the respective plug-in provider to exercise this. Through the plug-ins, we offer you the opportunity to interact with social networks and other users so that we can improve our offer and make it more interesting for you. (1) Our websites contain AddThis plug-ins. These plug-ins allow you to set bookmarks or share content with other users. Through the plug-ins, we offer you the opportunity to interact with the social networks and other users so that we can improve our offer and make it more interesting for you as a user. The legal basis for the use of the plug-ins is Art. 6 para. 1 sentence 1 lit. f) of the GDPR.

This information is processed on AddThis' servers in the United States. 3.Integration of YouTube videos

(1) We have integrated YouTube videos into our online offers, which are stored on http://www.YouTube.com and can be played directly from our website. These are all integrated in the "extended data protection mode", i.e. no data about you as a user is transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned in (2) be transferred. We have no influence on this data transfer.

2. Amazon Affiliate Program

(1) We are a participant in the Amazon Europe S. à.r.l. Associates Program and a partner in the Advertising Program, which is designed to provide a medium for websites to earn advertising fees by placing advertisements and links to www.amazon.de. We use the program to pursue the interest of displaying advertisements that are of interest to you and to make our website more interesting for users.
